Tenants Right to a Habitable Residence

  • As a tenant, you will have some rights for being able to live in an apartment. Your lease is going to outline a lot of this, but you should know some of your rights before you move in. You are the one who is paying to live in the area, so it is important that the landlord recognize your rights and take good care of you while you live there. One of the rights that you have as a tenant is the right to live in an apartment that is considered habitable.

To keep this as simple as possible, it is the responsibility of your landlord to make sure that you are living in an apartment that is in reasonable condition and that they provide you with certain necessities. The apartment doesn’t have to be modern and brand new, but it also shouldn’t be a health hazard or starting to fall apart at the seems. If you are scared to live there or feel like it is going to be bad for your health, then this is not a good place to call your home.

So, what about some of those necessities? The landlord isn’t going to hand you furniture and free food or anything, but they are required to make sure that you have clean drinking water into the apartment, hot water, and that the HVAC system is able to work properly. If they don’t, the landlord needs to get someone over there to get them fixed as soon as possible. Your bathroom should also work well so that you can use it and there should be no issues with pests or rodents around.

A good thing to remember here is that if there is a problem that you can see with the apartment itself, and it isn’t due to your own negligence or any of your items, then the landlord is probably the one who has to take care of the issue for you.

Finding a habitable place to live shouldn’t be something that you have to worry about. The landlord should already provide that for you so that you can feel comfortable and at home from the moment you walk in the door.
