Lawyers in a 42-year-old lawsuit against NYPD surveillance traded blows with the city Tuesday in the first court clash over NYPD monitoring of Muslims.
The controversial practice was tacked onto the old class

The plaintiffs contend that the NYPD cannot have a policy to record and retain talks with people not suspected of wrongdoing.

Peter Farell, a city lawyer, said the NYPD investigates based on threats, not religion, and claimed that few cop visits result in tapes.
"New York City remains at the center of the threat by Islamists who have been radicalized to violence," he said.

The city argues that radicalized Islamists still pose a threat.
The judge will rule at a later date.
The lawsuit

"This is not that different than in 1971," she said, referring to NYPD monitoring of political activism decades ago. "It makes me angry."
Faisa Ali, a staffer at the Arab-American Association of New York, also watched the arguments.
